For contracts started before 12/02/2012, the period prior to that date is calculated at 45 days/year (max 42 monthly salaries), with an overall cap of 720 days for unfair dismissal.

How much redundancy pay for unfair dismissal in Spain?

For contracts from 12 February 2012: 33 days of salary per year worked, capped at 24 monthly salaries. For older contracts, a dual scale applies: 45 days/year up to 11 February 2012 and 33 days/year thereafter, with an overall cap of 720 days.

What pay applies to objective or economic dismissal?

Dismissal for economic, technical, organisational or production reasons gives you the right to 20 days of salary per year worked, capped at 12 monthly salaries. The employer must give 15 days' notice or pay in lieu.

How is daily salary calculated?

The daily salary equals gross annual salary (including bonuses) divided by 365 days. This daily rate is multiplied by the number of redundancy days earned based on your length of service.

Is redundancy pay taxable in Spain?

Statutory redundancy pay is exempt from IRPF up to the mandatory amount set by the Workers Statute. Any excess is taxable as employment income. This calculator shows the gross figure before the exemption is applied.

What if the dismissal is fair?

A fair disciplinary dismissal carries no redundancy payment. You are, however, always entitled to your settlement payment (finiquito): unpaid wages, unused holiday, and the accrued proportion of any annual bonuses.
