Frequently asked questions

Is a private loan agreement legally valid in Spain?

Yes. Private loans are governed by Articles 1740 et seq. of the Spanish Civil Code. The private document is fully binding between the parties. For greater security — especially for significant sums — notarisation is recommended.

Are there taxes on private loans in Spain?

Private loans are subject to Transfer Tax (ITP) but exempt from payment. The borrower must file Form 600 with the regional tax office within 30 working days of signing. Any interest the lender receives is taxable income in the annual return.

Can the loan be interest-free?

Yes, perfectly valid. However, between family members, the AEAT may treat an interest-free loan as a gift. We recommend applying at least the legal interest rate and documenting the transaction carefully.

Lump sum vs. monthly instalments — what's the difference?

With a lump sum the borrower repays everything (capital + interest) on one agreed date. With monthly instalments the amount is divided into equal payments using the French amortisation method (constant instalment, capital and interest each month).
